حجية التوقيع الإلكتروني في الإثبات في التشريع الجزائري

Abstract

أدى اتطور التكنولوجي الحاصل في العالم على ثورة معلوماتية كبتَة بسخض عنها العديد من الدفاىيم التي غتَت لررى الدعاملات بتُ الأفراد ، و من بتُ ما منتج عنها نذكر العقد الإلكتًولٍ ولا يخفى عن النظتَ عند ذكرنا للعقد الإلكتًولٍ أن نقول التوقيع الإلكتًولٍ الذي زاحم التوقيع التقليدي في وظائفو و تفوق عليو في نقاط عدّة ، و بات اليوم لو من الشروط و الصور و الوظائف التي نظمتها التشريعات الدولية و الدقارنة من بينهم الدشرع الجزائري ما يرغم القضاة على الأخذ بو كدليل إثبات ذو قوة ثبوتية مطلقة كنظتَه التقليدي ، و عليو ستكون دراستنا حول حجية التوقيع الإلكتًولٍ في الإثبات في التشريع الجزائري . The technological development taking place in the world led to a major information revolution that resulted in many concepts that changed the course of transactions between individuals, and among what resulted from it we mention the electronic contract. It surpassed it in several points, and today it has conditions, forms, and functions that are regulated by international legislation and the comparison among them is the Algerian legislator, which compels judges to take it as evidence of absolute evidentiary power like its traditional counterpart, and accordingly our study will be on the authoritativeness of the electronic signature in Evidence in Algerian legislation
