الجرائم المتعلقة بالصحة العمومية

Abstract

نظرا للانعكاسات الخطيرة لجرائم الصحة العمومية، فقد اولاها المشرع الجزائري اهتمام كبير 11 المؤرخ في 02 جويلية سنة 2018 المتعلق - و يتجلى ذلك من خلال اصداره للقانون رقم 18 بالصحة، تناول هذا القانون مسألة الصحة بمختلف مجالاتها، نذكر على سبيل المثال تعريف الصحة العمومية ذلك بموجب المادة 29 منه، كما تضمن ذكر الجرائم الماسة بالصحة العمومية، و كذا آليات الحماية و الوقاية للتصدي لهذا النوع من الجرائم و ق د أشار من خلال النصوص القانونية إلى تدابير الضبط الإداري للوقاية من جرائم الصحة العمومية، و تسيسا على ما سبق ذلك -حاولنا ومن خلال هذه الدراسة - وبالاعتماد على المنهج الوصفي التحليلي، تسليط الضوء على ن وع من انواع جرائم الصحة العمومية و المتمثل في الجرائم المتصلة بمهنة الطب و المتعلقة بالأخطاء الطبية العمدية و غير العمدية، كنموذج من هذه الجرائم ، كما اشتملت هذه الدراسة على بعض الجرائم الأخرى الماسة بالصحة العم ومية التي ذكرها قانون العقوبات الجزائري. Given the serious repercussions of public health crimes, the Algerian legislature has paid great attention to them. This is evident in the issuance of Law No. 18 on Health. This law addresses the issue of health in its various aspects. For example, we mention the definition of public health under Article 29. It also includes a mention of crimes against public health. As well as the protection and prevention mechanisms to combat this type of crime, the legal texts have indicated administrative control measures to prevent public health crimes, and based on the above - Through this study, relying on a descriptive and analytical approach, we attempted to shed light on a type of public health crime, namely crimes related to the medical profession and related to intentional and unintentional medical errors, as an example of these crimes. This study also included some other crimes affecting public health mentioned in the Algerian Penal Code.
