Abstract
يعتبر التحكيم عدالة خاصة و وسيلة قضائية لحل المنازعات بين الأشخاص الدولية بعيدا عن
استعمال القوة أو التهديد بها في إطار اقترام مبادئ القانون باعتباره من الطرق البديلة لحل المنازعات
التجارية الدولية و بديل للقيود التي فرضها القضاء العادي، و قد لعب التحكيم دور هام في تعديل
التشريعات الوطنية لكثير من الدول كما هو الشأن في القانون الجزائري، قيث واكب المشرع
التطورات الحاصلة و عمل على تنظيم الأقكام الخاصة بالتحكيم التجاري الدولي ضمن قانون
الإجراءات المدنية و الإدارية، بما يضمن تفضيل هذه الوسيلة البديلة لحل المنازعات.
Arbitration is considered a form of private justice and a judicial means for resolving disputes between international entities, away from the use of force or the threat thereof, and within the framework of respecting the principles of law. As an alternative dispute resolution (ADR) mechanism for international commercial disputes, it serves as a substitute for the limitations imposed by ordinary courts. Arbitration has played a significant role in amending the national legislation of many countries, as is the case with Algerian law, where the legislator has kept pace with ongoing developments and worked to regulate the provisions of international commercial arbitration within the Code of Civil and Administrative Procedure, in a manner that ensures the preference for this alternative means of dispute resolution.
