إستغلال النفوذ في ظل القانون 06 / 01

Abstract

بصدور القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، استحدث المشرع العديد من الجرائم في مجال مكافحة الفساد لم تكن موجودة في قانون العقوبات الجزائري، وهي مستوحاة جميعها من اتفاقيات الأمم المتحدة لمكافحة الفساد. ومن بين هذه الجرائم المستحدثة، نجد جريمة استغلال النفوذ، التي تندرج ضمن الفساد الإداري. وتُعد هذه الأخيرة من أهم الجرائم المستحدثة، وهي جوهر هذا الموضوع، إذ تتطلب مواجهتها منظومة قانونية متكاملة، وهو ما سعى المشرع الجزائري إلى تحقيقه بإصدار قانون الوقاية من الفساد ومكافحته. With the issuance of Law 06-01 relating to the prevention and combating of corruption, the legislator introduced many crimes in the field of combating corruption that did not exist under the Algerian Penal Code, and they are all inspired by the United Nations anti-corruption conventions. Among these new crimes we find the crime of exploitation of influence, which falls within corruption. Administrative. The latter is considered one of the most important new crimes and is the essence of this topic, as confronting this crime requires an integrated legal system, which is what the Algerian legislator sought to achieve by issuing the law for preventing and combating corruption.
