فعالية التحكيم الالكتروني في منازعات التجارة الالكترونية عبر الحدود

Abstract

يعد اللجوء إلى التحكيم الالكتروني من أحسن وسائل فض منازعات التجارة الالكترونية وأحدث التطورات في عصر التكنولوجيا، حيث تجرى إجراءاته عبر شبكة الانترنت، مما يحقق ميزة السرعة ويختصر الوقت الجهد، كما أن التحكيم الالكتروني يتم اللجوء إليه عبر اتفاق الأطراف. وقد خلصت دراستنا إلى إمكانية تطبيق التحكيم الالكتروني على منازعات التجارة الالكترونية وهذا استنادا لمصادره المتنوعة، كما أن نظام التحكيم الالكتروني لا يختلف عن نظام التحكيم التقليدي فهدفهما واحد وهو الوصول إلى تسوية المنازعات بطريقة ودية.

Resorting to electronic arbitration is one of the best means of resolving e-commerce disputes and one of the latest developments in the age of technology, as its procedures are conducted via the Internet, which achieves the advantage of speed and saves time and effort. Electronic arbitration is resorted to through the agreement of the parties. Our study concluded that it is possible to apply electronic arbitration to e-commerce disputes, based on its diverse sources. Moreover, the electronic arbitration system is no different from the traditional arbitration system, as their goal is the same: to reach a settlement of disputes in an amicable manner.
