Abstract
تُعد جريمة قتل المولود حديثاً جريمة استثنائية تستقطب اهتمام الباحثين في المجالات القانونية والاجتماعية نظراً لأبعادها القانونية والإنسانية الفريدة. وتختلف هذه الجريمة عن جرائم القتل العمد التقليدية؛ إذ تراعي التشريعات الحالة النفسية والاجتماعية للأم عقب الولادة، مما يفضي إلى إقرار أحكام مخففة أو استثنائية فيما يتعلق بالعقوبة.
وتركز هذه الدراسة على عدة محاور رئيسية، تشمل: تحليل الأركان القانونية للجريمة، والسياسات الجنائية والعقابية المطبقة، والأبعاد الاجتماعية والنفسية والأخلاقية المحيطة بالواقعة. كما تهدف الدراسة إلى فهم الدوافع الكامنة وراء ارتكاب الجريمة، ودور الظروف الاجتماعية والنفسية في التأثير على سلوك الأم، فضلاً عن تقييم مدى فعالية العقوبات والتدابير الوقائية وبرامج التوعية الرامية إلى الحيلولة دون وقوع مثل هذه الجرائم.
وتخلص الدراسة إلى أن التصدي الناجح لهذه الجريمة يتطلب تحقيق توازن بين حماية حياة الطفل وتحقيق العدالة ومراعاة الوضع الإنساني للأم، مع التركيز على مبدأ تفريد العقوبة وتبني سياسات وقائية واجتماعية لدعم الأمهات الجدد.
The murder of a new born childish an exceptional crime that attracts the attention of legal and
social scientists due to its unique legal and humanitarian aspects. This crime differs from
traditional premeditated murder, as legislation takes into account the mother's psychological
and social state after childbirth, resulting in mitigating or exceptional provisions regarding
punishment.
This study of the crime focuses on several key areas: analyzing the legal elements of the
crime, the applicable criminal and penal policies, and the social, psychological, and moral
dimensions surrounding the incident. The study also aims to understand the motives behind
committing the crime. The role of social and psychological conditions in influencing the
mother’s behavior, as well as evaluating the effectiveness of penalties and preventive and
awareness-raising methods to avoid the occurrence of such crimes.
The study confirms that successfully addressing this crime requires a balance between
protecting the child’s life and achieving justice, and taking into account the mother’s
humanitarian situation, with a focus on individualizing punishment and adopting preventive
and social policies to support new mothers.
