Abstract

تعد جريمة المضاربة غير المشروعة من أهم الجرائم الاقتصادية التي تضر الاقتصاد الوطني وتزعزع استقرار السوق من خلال التلاعب بالأسعار وخلق حالة الندرة وهو ما يؤدي تدهور القدرة الشرائية للمستهلك وللحد من انتشار هذه الممارسات غير المشروعة دفع بالمشرع الجزائري إلى استحداث قانون خاص بها للحد من مختلف الممارسات التي تمس باقتصاد السوق 21 المتعلق بالمضاربة غير المشروعة حدد أهم صور هذه الجرائم مع بيان أركانها وكافة / فالقانون 12 الآليات والتدابير الخاصة بالبحث والتحري والمحاكمة في هذا النوع من الجرائم حى لا ي ترك أي فرصة للجاني للإفلات من العقاب وهي من أبرز صور التدخل الجنائي في مجال الأعمال وضبط السوق. The crime of illegal speculation is one of the most significant economic crimes that harm the national economy and destabilize the market by manipulating prices and creating a scarcity, which leads to the deterioration of the consumer's purchasing power. To limit the spread of these illegal practices, the Algerian legislator has introduced a specific law to curb various practices that affect the market economy. Law No. 21/15 on illegal speculation defines the main forms of these crimes, outlines their elements, and details all the mechanisms and measures for investigation, prosecution, and trial in this type of crime, leaving no room for the perpetrator to escape punishment. This represents one of the most prominent forms of criminal intervention in the business field and market regulation.
