Abstract

منح الدستور الجزائري من خلال التعديل الدستوري لسنة 0202 دورا هاما لرئيس الجمهورية في عملية وضع القواعد القانونية، والتي هي في الأساس من اختصاصات السلطة التشريعية، حيث يمارس اختصاصه التشريعي في الظروف العادية عن طريق اللجوء إلى الاستفتاء وإصدار القانون ا ولاعتراض عليه والمبادرة بشكل غير مباشر بمشاريع القوانين، ا ولتصديق على المعاهدات الدولية. كما يقوم بدور مباشر في التشريع في غياب البرلمان وذلك عن طريق التشريع بأوامر في حالة العطلة البرلمانية وفي حالة حل المجلس الشعبي الوطني، كما خصّه الدستور بسلطة التشريع بأوامر في الظروف غير العادية، إلا أن هذه السلطة قيدها المؤسس الدستوري بعدة قيود بعضها موضوعية وأخرى شكلية، لاسيما خضوع هذه الأوامر للرقابة البرلمانية والرقابة الدستورية.
