التأمين عن المسؤولية المدنية على حوادث السيارات

Abstract

سن المشرع الجزائري الأمر رقم 74 - 15 المعدل والمتمم بالقانون رقم 88 - 31 المتعلق بالزامية التأمين على السيارات وبنظام التعويض عن حوادث المرور، وذلك من أجل حماية المتضررين عن طريق إلتزام شركة التأمين بالتعويض في المقابل يلتزم المؤمن له بدفع الأقساط، كأساس عام. كما نجد المشرع الجزائري قد حدد كيفية تقدير التعويض عن الأضرار الجسمانية، وذلك عن طريق نصوص قانونية، أما بالنسبة للأضرار المادية فقد ترك مسألة تقديرها للتعليمات الإدارية لشركات التأمين، والتي قد تخضع في مجملها لرقابة القضاء. يتم الحصول على التعويض عن الأضرار الناجمة عن حوادث السيارات، إما عن طريق إجراءات ودية بحيث تلتزم شركة التأمين بالتعويض، أو عن طريق القضاء، أو عن طريق صندوق ضمان للسيارات في حالات استثنائية.

The Algerian legislator has promulgated Order No. 74-15 amending and supplementing Law No. 88-31 on the obligation to insure cars and the system of compensation for traffic accidents, to protect those affected by the insurance company’s obligation to compensate for which the insured is required to pay premiums, as a general basis. The Algerian legislator has also determined how compensation for bodily injury can be assessed by means of legal texts. In the case of property damage, he left the question of his assessment of the insurance companies' administrative instructions, which in their entirety may be subject to judicial review. Compensation for damage caused by car accidents is obtained either through amicable procedures so that the insurance company is obliged to compensate, or through the judiciary, or through Car guarantee fund in exceptional cases.
