Abstract

تُعد الوثائق والمعلومات الإدارية ركيزة أساسية للنشاط الإداري في الدولة الحديثة، إذ تمثل الذاكرة القانونية والمادية للإدارة، وأداة عمل ضرورية لموظفيها. وقد وسّع المشرع الجزائري من مفهوم الوثيقة الإدارية ليشمل كافة الأشكال الورقية والإلكترونية والسمعية البصرية، مما يعكس تنوع الأوعية المعلوماتية التي تتعامل معها الإدارة المعاصرة. إلا أن هذا التوسع يفرض تحديات متزايدة، خاصة في ظل التحول الرقمي، ما يستدعي تعزيز الأمن السيبراني وتطوير آليات الأرشفة الرقمية. تكتسب هذه الوثائق أهمية مضاعفة نظراً لارتباطها بحق المواطن في الاطلاع عليها، مما يُكرس مبدأ الشفافية ويعزز الثقة بين الإدارة والمواطن، ويساهم في مكافحة الفساد. وتهدف هذه الدراسة إلى تحليل الإطار القانوني المنظم للوثائق الإدارية في الجزائر، لا سيما ما يتعلق بالوثائق السرية أو المصنفة، مع تقييم الآليات المعتمدة لحمايتها إداريًا وجزائيًا، خاصة في ضوء الأمر 21-09 لسنة 2021 المتعلق بحماية المعلومات والوثائق الإدارية. تسعى الدراسة إلى إثراء البحث العلمي في مجالات القانون الإداري وقانون المعلومات، من خلال تقديم قراءة نقدية للإطار التشريعي الوطني، وتوضيح مفاهيم الوثائق الإدارية وطرق الاطلاع عليها، بما يخدم تحقيق الشفافية وضمان استمرارية المرافق العامة.

Administrative documents and information form a cornerstone of modern state administration, serving as both the legal and material memory of public institutions and an essential tool for administrative staff. The Algerian legislator has adopted a broad definition of administrative documents, encompassing written, electronic, audiovisual, and various material formats. This reflects the diverse nature of modern information management but also introduces significant challenges, especially with the ongoing digital transformation, which requires robust cybersecurity and advanced digital archiving systems. These documents are not only vital for internal administrative functions but also for citizens, who are granted a conditional legal right to access them. This access is key to promoting administrative transparency, enhancing public trust, and combating corruption. This study aims to analyze the legal framework governing administrative documents in Algeria, focusing particularly on classified or confidential materials, and evaluating the mechanisms—both administrative and penal—put in place to protect them. It places particular emphasis on Ordinance No. 21-09 of June 8, 2021, concerning the protection of administrative documents and information. Scientifically, the study contributes to the Algerian legal literature by providing a critical analysis of legislative and regulatory texts in administrative and information law. Practically, it highlights how protecting administrative information underpins the continuity of public services and supports the principles of transparency and the rule of law.
