جرائم النصب عبر الوسائط الرقمية في التشريع الجزائري

Abstract

تتناول هذه المذكرة موضوع جرائم النصب والاحتيال عبر الوسائط الرقمية في التشريع الجزائري، باعتبارها من الجرائم المستحدثة التي نتجت عن التطور المتسارع لتكنولوجيات الإعلام والاتصال وانتشار المعاملات الإلكترونية. وتهدف الدراسة إلى تحديد مفهوم هذه الجرائم وبيان خصائصها وصورها المختلفة، مع توضيح أركانها القانونية وتمييزها عن جريمة النصب التقليدية. كما تعرض الإطار التشريعي الذي اعتمده المشرع الجزائري لمكافحتها من خلال أحكام قانون العقوبات والقوانين الخاصة ذات الصلة. وتتناول كذلك وسائل التحري الرقمية وأساليب الإثبات الإلكتروني المعتمدة في الكشف عن هذه الجرائم وملاحقة مرتكبيها. كما تبرز دور الأجهزة الأمنية والهيئات المختصة في الوقاية منها ومكافحتها. وتناقش الدراسة أهم التحديات التقنية والقانونية والمؤسساتية التي تواجه جهود المكافحة، خاصة في ظل الطابع العابر للحدود للفضاء الرقمي. وقد خلصت إلى ضرورة تعزيز المنظومة القانونية وتطوير القدرات التقنية والبش رية وتكثيف التعاون الدولي لمواجهة هذه الجرائم بفعالية أكبر .

This dissertation addresses the issue of fraud and scam crimes committedthrough digital media in Algerian legislation, as one of the emergingforms of crime resultingfrom the rapiddevelopment of information and communication technologies and the widespread use of electronic transactions. The studyaims to definethese crimes, identifytheircharacteristics and variousforms, and explaintheirlegalelementswhiledistinguishingthemfromtraditionalfraud offenses. It also examines the legislativeframeworkadopted by the Algerian legislator to combat such crimes through the provisions of the Penal Code and relatedspeciallaws. Furthermore, the studydiscusses digital investigation methods and electronicevidenceproceduresused to detectthese crimes and prosecutetheirperpetrators. It highlights the role of securityagencies and specialized institutions in preventing and combatingcybercrime. In addition, the researchanalyzes the main technical, legal, and institutional challenges facing efforts to combat these offenses, particularly due to their cross-border nature in the digital environment. The studyconcludesthatstrengthening the legalframework, developingtechnical and humancapacities, and enhancing international cooperation are essential to effectivelyaddressthese crimes.
