الضوابط القانونية للملكية الفكرية في البيئة الرقمية

Abstract

تناولت هذه الدراسة الضوابط القانونية لحماية الملكية الفكرية في البيئة الرقمية، من خلال بيان مفهوم الملكية الفكرية والبيئة الرقمية والأساس القانوني لحمايتها في التشريع الجزائري والاتفاقيات الدولية، كما سلطت الضوء على أهم صور الاعتداءات الالكترونية والآليات القانونية والتقنية المقررة لمواجهتها وخلصت الدراسة إلى أن الحماية الفعالة للملكية الفكرية في البيئة الرقمية تتطلب تعزيز التشريعات الوطنية وتطوير الوسائل التقنية وتدعيم التعاون الدولي لمواكبة التطورات التكنولوجية.

This study examines the legal regulations governing the protection of intellectual property in the digital environment. It highlights the concept of intellectual property, its legal basis under Algerian legislation and international agreements, as well as the main forms of cyber infringements and the mechanisms used to combat them. The study concludes that effective protection requires strengthened legislation, advanced technical measures, and enhanced international cooperation to keep pace with technological developments
