Abstract

يُعدّ العقد الإلكتروني من أهم نتائج التطور التقني والتكنولوجي، الذي اعتمد على أساليب إلكترونية حديثة تُسهّل التعاقد عن بُعد، فظهرت المحررات الإلكترونية، ومعها وُجدت ضرورة استخدامها كدليل إثبات، وعند دراسة موضوع الكتابة الإلكترونية كدليل في العقد الإلكتروني، تنوعت المناهج القانونية، بين المنهج الوصفي في تعريف مفهوم الكتابة الإلكترونية وخصائصها، والمنهج التحليلي في تحليل النصوص القانونية، والمنهج المقارن كلما دعت الحاجة. The electronic contract is one of the most important results of technical and technological development, which depends on modern electronic methods that facilitate remote contracting, so electronic documents appeared and with them the need to be used as evidence for proof, and while studying the subject of electronic writing as evidence in the electronic contract, several exposure was made. Legal curricula, varied between the descriptive approach in defining the concept of electronic writing and its characteristics, the analytical approach in analyzing legal texts, and the comparative approach whenever the need arises.
