جرائم عصابات الأحياء وسبل مكافحتها

Abstract

تعد جريمة تكوين عصابة الأحياء من أشد الجرائم تهديدا لأمن واستقرار المجتمعات بصفة عامة والمجتمع الجزائري بصفة خاصة،والهدف من دراسة هذا الموضوع هو معرفة مدى نجاعة الآليات والجزاءات التي تناولها المشرع الجزائري من خلال الأمر 20 02 المتعلق بالوقاية من عصابات الأحياء - ومكافحتها على المستوى الوطني والمحلي. وقد وضع المشرع الجزائري عقوبات متفاوتة من حيث تشديد العقوبات على مرتكبي الجرائم حسب خطورة الفعل المنسوب لفاعله ،حيث جاءت في صورة أفعال بسيطة عقوبتها الحبس ثم تتدرج إلى غاية وصولها الحبس المؤبد.

Abstract neighborhood gangs formation is considered as one of the greatest crimes that threaten the security and stability of societies in general and Algerian society in particular. The aim of studying this topic is to determine the effectiveness of the mechanisms and penalties that the Algerian legislator addressed through Order 03-20 related to the prevention and fighting of neighborhood gangs at the National and local level. The Algerian legislator has set varying penalties depending on the severity of the crime attributed to the perpetrator as they come in the form of simple acts punishable by imprisonment and then graduate to life imprisonment.
