جريمة المخدرات على ضوء القانون رقم 23-05

Abstract

في ظل استفحال جريمة المخدرات وانتشارها المتزايد في أوساط المجتمع الجزائري، والتي أصبحت تشكل تهديدا خطيرا للسلامة العامة والأمن الاجتماعي، بادر المشرع الجزائري إلى تعديل القانون رقم 04_18 المتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين بها، من خلال إصدار القانون رقم 23_05 سعيا منه لتعزيز الجهود لمكافحة هذه الآفة والتصدي لها، فوضع تصنيف وطني إلى جانب التصنيف الدولي للمخدرات والمؤثرات العقلية بهدف سد الطريق أمام أي جدل حول طبيعة المادة المستعملة، من خلال ضبط إطار قانوني يشمل مختلف الأفعال التي تدخل ضمن دائرة التجريم التي تتنوع ما بين الجنح والجنايات، التي يُشترط لقيامها تحقق الركن المعنوي بعنصريه العام والخاص، الأمر الذي يُضفي خصوصية لجريمة المخدرات، إضافة إلى تركيز المشرع على الجانب الوقائى من خلال التعمق في الاستراتيجية الوطنية لمكافحة المخدرات وتوسيع نطاقها وإشراك العديد من القطاعات الفاعلة في هذا المجال للوقاية من هذه الافة، دون إهمال الجانب العقابي.

In light of the growing prevalence of drug crime in Algerian society, which has become a serious threat to public safety and social security, the Algerian legislator took the initiative to amend Law No. 04_18 on the prevention of narcotic drugs and psychotropic substances and the suppression of their illicit use and trafficking. This amendment was issued by Law No. 23_05, in an effort to strengthen efforts to combat and confront this scourge. A national classification was established alongside the international classification of narcotic drugs and psychotropic substances, with the aim of blocking any controversy over the nature of the substance used. This was achieved by establishing a legal framework that encompasses various acts that fall within the scope of criminalization, which ranges from misdemeanors to felonies. The criminal offense requires the fulfillment of the moral element, with its general and specific components, which gives drug crime a special status. Furthermore, the legislator focused on the preventive aspect by deepening the national strategy to combat drugs, expanding its scope, and involving many active sectors in this field to prevent this scourge, without neglecting the punitive aspect.
