النظام القانوني للسلطة الوطنية المستقلة للانتخابات

Abstract

تهدف هذه الدراسة العلمية إلى تسليط الضوء على النظام القانوني للسلطة الوطنية المستقلة للانتخابات التي أنشئت بموجب القانون العضوي 19 07 ، في خضم الحراك السياسي الشعبي - في شهر فيفري سنة 2019 ، وبعد التعديل الدستوري الذي نص على إدارة مستلقة ممثلة في السلطة الوطنية المستقلة للانتخابات، تشرف على جميع العمليات الانتخابية، ونتج عنه إصدار الأمر رقم 21 01 المتضمن القانون العضوي المتعلق بنظام الانتخابات، والذي من خلاله تطرقنا - إلى الطبيعة القانونية والإطار التنظيمي والوظيفي للسلطة الوطنية، ومدى ضمانها لتحقيق مبدأ شفافية نزاهة العملية الانتخابية، وهذا من خلال دراسة ماهية وأهمية السلطة المستقلة، والتشكيلة و هياكل السلطة، كذلك صلاحياتها ودورها بداية عملية التسجيل في القوائم الانتخابية ومراجعتها مرورا بالتحضير لعمليات الانتخابية وإجراءات التصويت والفرز إلى غاية إعلان النتائج الأولية، وهذا بتنظيمها وإدارتها والإشراف عليها، وكذلك دورها في الطعون والمنازعات الإنتخابية وهذا لتحقيق استقلاليتها الإدارية والمالية، التي تضمن لها الحياد عن جميع الأطراف المشاركة. حيث أنها بدأت بإلتزام وهو المصادقة على ميثاق أخلاقيات الممارسة الانتخابية وانتهت بحق وهو التقاضي على درجتين، مع مراعاتها سلامة وصحة المواطنين بتطبيق المحكم لتدابير الوقائية من -أجل تفادي تفشي فيروس كورونا كوفيد 19

As Well As Its Validity And Role, The Beginning Of The Process Of Registering In The Electoral Lists And Reviewing Them, Passing Through The Preparation Of Electoral Processes, Voting And Counting Procedures, Until The Announcement Of The Preliminary Results. This Is Organized, Managed And Supervised. As Well As Its Role In Electoral Appeals And Disputes, And This Is To Achieve Its Administrative And Financial Independence, Which Guarantees It Impartiality From All Participating Parties. As It Began With A Commitment, Which Is The Ratification Of The Code Of Ethics For Electoral Practice, And Rightly Ended, Which Is Litigation On Two Levels, Taking Into Account The Safety And Health Of Citizens, By Applying The Arbitrator To Preventive Measures In Order To Avoid The Spread Of The Corona Virus (Covid-19).
