Abstract

سعت الدراسة الى التعريف بمهنة التوثيق ودورها في استقرار المعاملات في القانون الجزائري كما أن نظام التوثيق يعتبر أهم ضمان لحفظ الحقوق وقطع المنازعات واستقرارالمعاملات بين الأفراد لذلك فقد حظى بجانب من الإهتمام من طرف القوانين الجزائريةالتي عينت الأشخاص القائمين عليه وازدادت الحاجة الى التوثيق نتيجة تشعب جوانب الحياة حيث أصبح المتعاقد عاجزا عن معرفةحقوقه والإستعانة بذوي الإختصاص في إبرام العديد من العقود للإلمام بمعطيات العقدوعليه فإن دور التوثيق أصبح اليوم لايقف حد إضفاء الصبغة الرسمية على العلاقات التعاقدية فقط بل لحماية المعاملات القانونية وتقديم النصائح والتوجيهات The study sought to introduce the profession of documentation and its role in the stability of transactions in Algerian law, and the documentation system is considered the most important guarantee for preserving rights, cutting off disputes and stabilizing transactions between individuals, so it has received a side of attention from the Algerian laws that appointed the people in charge of it, and the need for documentation increased as a result The divergence of aspects of life, where the contractor has become unable to know his rights and seek the help of specialists in concluding many contracts in order to gain knowledge of the data of the contract, and accordingly, the role of documentation today does not stop at formalizing contractual relations only, but rather to protect legal transactions and provide advice and guidance.
