الإثبات عن طریق شھادة الشھود في المواد التجاریة

Abstract

إن شهادة الشهود تعد من أهم وسائل الإثبات التي أقرها القانون الجزائري، خاصة في ا بكل طرق الإثبات، ومن بينها الشهادة نظرا لطبيعتها التي 􀁏 المسائل التجارية التي يمكن إثبا تتطلب السرعة والائتمان، ويتم الاعتماد عليها حتى في بعض المسائل المدنية والجنائية، ونحن اليوم تطرقنا لموضوع الإثبات بشهادة الشهود في المسائل التجارية على وجه الخصوص، وقد تبين لنا أن ال التجاري وهذا ما جعل العديد من القوانين تنظمها 􀂀 همية كبيرة خاصة في ا 􀂻 الشهادة تتميز وتبين حدودها ونطاقها إضافة إلى اجتهادات الفقه والقضاء في تعريفها، كما أن لها عدة أكان وشروط وجب توفرها لصحة الشهادة، وهي تعد من أبرز وأهم وسائل الإثبات التي يعتمد عليها لسهولة والمرونة تماشيا مع طبيعة 􀀽 ا لا تعطل سير الدعوى، بل تتميز 􀂅 ال التجاري نظرا إلى أ 􀂀 في ا التجارية التي تعتمد على مبدأ حرية الإثبات. 􀂁 المسائل والقضا The deposition of witnesses is one of the most important means of proof approved by Algerian law, particularly in commercial matters which can be proven by any means. Means including testimony due to its expeditious nature, is invoked even in some civil and criminal cases, and today we have touched on the issue of testimonial evidence in commercial matters in particular, and it has become clear to us that testimony is of great importance especially in the commercial field, and this has caused many laws to regulate it and indicate its limits and scope, in addition to case law and justice for define it, and it has several pillars and conditions that must be met for the validity of the testimony, and it is considered to be one of the most important means of evidence relied on in the commercial field, since it does not impede the progress of the case, but is characterized by ease and flexibility in line with the nature of the commercial issues which come under the principle of freedom of evidence.
