الحرية الدينية لغير المسلمين في الجزائر

Abstract

امتثالا لالتزاماتها الدولية المتعلقة بحقوق الانسان والتي تؤكد على عدم التمييز في ممارسة الحقوق والحريات الأساسية تعترف الجزائر بالحق في ممارسة الشعائر الدينية لغير المسلمين كمظهر من مظاهر الحق في حرية الدين، غير أن الجزائر كدولة إسلامية ولضمان عدم تعارض ممارسة هذه الشعائر مع مبادئ الشريعة والدين الإسلامي عدم الاخلال بالنظام العام، عملت على تنظيم ممارستها فرديا وجماعيا من خلال اخضاعها من جهة لنظام التصريح المسبق الذي يخضع للسلطة التقديرية للإدارة المختصة، ومن جهة أخرى فرض عقوبات ردعية على مخالفة أحكامها المنظمة لها، وذلك انطلاقا من القيود التي تسمح الاتفاقيات الدولية لحقوق الانسان للدول بفرضها على ممارسة هذه الحرية مع ذلك تكفل الجزائر لغير المسلمين ضمانات وآليات تعمل على حمايتها في حال حصول انتهاك أو تعدي على ممارسة حريتهم الدينية، سواء من خلال آليات الحماية الوطنية أو الدولية .

In compliance with its international human rights obligations, which emphasize non-discrimination in the exercise of fundamental rights and freedoms, Algeria recognizes the right of non-Muslims to practice their religious rites as an expression of the right to freedom of religion. However, as an Islamic state and in order to ensure that such practices do not conflict with the principles of Sharia and Islam or disrupt public order, Algeria has regulated their individual and collective practice. This is done by subjecting them to a prior authorization system, which falls under the discretionary authority of the relevant administrative body, and by imposing deterrent penalties for violations of the relevant regulations. Nevertheless, Algeria provides non-Muslims with guarantees and mechanisms to protect their religious freedom in the event of any violation or infringement, whether through national or international protection mechanisms.
