النطام القانوني لعقد الإمتياز

Abstract

يلعب عقد الامتياز دورا فعالا ومزدوجاً من خلال تخفيف عبء التسيير على الدولة منجهة، وتلبية الاحتياجات العامة للجمهور من جهة أخرى، كما أصبح هذا الأسلوب كالية فعالة تلجأ إليها الإدارة لإشراك القطاع الخاص في تسيير المرافق العامة للاستفادة من مهارات القطاع الخاص والخبرات الأجنبية، وللحصول على جودة عالية في تلبية رغبات الأفراد والمنتفعين من جهة أخرى. ونستنتج أنه لا يوجد قانون أساسي في التشريع الجزائري ينظم هذا الأسلوب أو هذا النوع من العقود، لكن ينظم بمجموعة من النصوص القانونية المبعثرة، تشمل الحقوق والالتزامات من أجل تحقيق المصلحة العامة. The concession contract plays an effective and duplicative role by easing the burden of operating on the State and addressing the public's overall needs. This method has also become an effective agency for management to engage the private sector in running public utilities to take advantage of the skills of the private sector and foreign expertise, and to obtain high quality in meeting the wishes of individuals and beneficiaries. We conclude that there is no basic law in Algerian legislation governing this method or type of contract, but it is regulated by a series of scattered legal texts, including rights and obligations in the public interest.
