Abstract
تتناول هذه الدراسة النظام القانوني والإجرائي المنظم لمؤسسة قاضي التحقيق في المنظومة
القضائية الجزائرية، مع التركيز على طرق اتصاله بالدعوى العمومية وأوامره القضائية في ظل أحكام
14 المتضمن قانون الإجراءات الجزائية. تهدف الدراسة إلى تفكيك الطبيعة - القانون الجديد رقم 25
الوظيفية المزدوجة لقاضي التحقيق وبيان مدى نجاعة الرقابة القضائية والاستئنافية التي تمارسها غرفة
الاتهام بصفتها هيئة التحقيق العليا، وباعتماد المنهج الوصفي التحليلي، يخلص البحث إلى أن
الإصلاحات التشريعية الأخيرة أسست لعهد إجرائي جديد يعزز ضمانات المحاكمة العادلة، ويكرس
الطابع الاستثنائي للتدابير المقيدة للحرية كالحبس المؤقت، مما يسهم في تحقيق التوازن العملي والميداني
بين مقتضيات مكافحة الجريمة وصون حقوق الدفاع وحماية الحريات الأساسية للأفراد.
This study examines the legal and procedural framework governing the
institution of the investigative judge within the Algerian judicial system, focusing
on the mechanisms of initiating public action and the issuance of judicial orders
under the new Law No. 25-14 concerning the Criminal Procedure Code. The
research aims to deconstruct the dual functional nature of the investigative judge
and evaluate the effectiveness of the judicial and appellate oversight exercised by
the Indictment Chamber as the supreme investigative body. Utilizing a
descriptive-analytical approach, the study concludes that recent legislative reforms
have established a new procedural era that strengthens fair trial guarantees and
reinforces the exceptional nature of liberty-restricting measures, such as pre-trial
detention. Ultimately, this framework achieves a practical and field-level balance
between the imperatives of combating crime, safeguarding defense rights, and
protecting the fundamental freedoms of individuals.
