المسؤولية الجزائية للشاهد في التشريع الجزائري

Abstract

عالجنا من خلال موضوع المسؤولية الجزائية للشاهد في التشريع الجزائري جوانب المسؤولية الجزائية التي يتحملها الشاهد من الناحيتين الموضوعية والإجرائية. حيث تناولنا في الجانب الموضوعي الإطار المفاهيمي لشهادة الشهود بصورتيها التقليدية والإلكترونية، وكيف نظم المشرع الجزائري الشهادة الإلكترونية ضمن عدة قوانين تماشيا مع التطورات التكنولوجية وتحديث منظومة العدالة، بالإضافة إلى الجرائم المرتبطة بشهادة الشهود من مفهومها وصولا لأركانها والتي تنقسم إلى جرائم يرتكبها الشاهد وجرائم ترتكب ضده، وكذا إستعراض تدابير وضمانات حماية الشاهد على الصعيد الوطني. أما في الجانب الإجرائي تطرقنا إلى أحكام هذه المسؤولية من خلال شرح الإلتزامات المفروضة على الشاهد في مراحل الدعوى العمومية (التحقيق الاستدلالي،التحقيق الابتدائي،المحاكمة)،كما ناقشنا كيفية تعامل الجهات القضائية مع الشاهد في حالة الإخلال بها والعقوبات الصارمة لكل جريمة مع تسليط الضوء على حالات إعفاء الشاهد من المسؤولية الجزائية .

In addressing the topic of the criminal liability of witnesses in Algerian legislation, we examined the various aspects of such liability from both substantive and procedural perspectives. On the substantive side, we explored the conceptual framework of witness testimony in its traditional and electronic forms, and how the Algerian legislator has regulated electronic testimony through several laws in line with technological advancements and the modernization of the justice system. We also analyzed crimes related to witness testimony—from their definitions to their legal elements—distinguishing between crimes committed by the witness and those committed against them, in addition to presenting the national measures and safeguards for witness protection. On the procedural side, we discussed the legal provisions governing this liability by explaining the obligations imposed on witnesses during the different stages of public prosecution (preliminary investigation, judicial investigation, and trial). We also examined how judicial authorities respond to violations of these obligations and the strict penalties prescribed for each offense, while highlighting the cases in which a witness may be exempted from criminal liability.
