Abstract
تناولت هذه المذكرة العلاقة بين السلطتين التنفيذية والتشريعية في الجزائر في ظل التعديل الدستوري لسنة 2020 والقانون العضوي رقم 23-06، من خلال تحليل مظاهر التعاون والرقابة المتبادلة بينهماوهدفت هذه الدراسة إلى بيان مدى تكريس مبدأ الفصل المرن بين السلطات ومدى تحقيق التوازن المؤسسي داخل النظام الدستوري الجزائري. كما عالجت دور السلطة التنفيذية في العملية التشريعية، خاصة من خلال المبادرة بمشاريع القوانين والتشريع بالأوامر، مقابل وسائل الرقابة البرلمانية على الحكومة. وتوصلت إلى أن المنظومة الدستورية الحديثة عززت الإطار التنظيمي للعلاقة بين السلطتين، غير أن الكفة ما تزال تميل عملياً لصالح السلطة التنفيذية. وانتهت الدراسة إلى مجموعة من النتائج والتوصيات الرامية إلى تعزيز التوازن المؤسسي وتفعيل الرقابة البرلمانية وترسيخ ثقافة المساءلة والشفافية This dissertation examined the relationship between the executive and legislative branches in Algeria in light of the 2020 constitutional amendment and Organic Law No. 23-06, through an analysis of the manifestations of cooperation and mutual oversight between them. The study aimed to clarify the extent to which the principle of flexible separation of powers is enshrined, as well as the degree of institutional balance achieved within the Algerian constitutional system. It also addressed the role of the executive branch in the legislative process, particularly through the initiation of draft laws and legislation by ordinance, in contrast with parliamentary oversight mechanisms over the government. The study concluded that the contemporary constitutional framework has strengthened the regulatory structure governing the relationship between the two branches; however, in practice, the balance still largely leans in favor of the executive branch. Finally, the research reached a set of findings and recommendations aimed at strengthening institutional balance, enhancing parliamentary oversight, and consolidating a culture of accountability and transparency.
