وقف تنفيذ القرار الإداري

Abstract

بعد تفعيل نظام وقف تنفيذ القرارات الإدارية ضرورة حتمية فرضت لتحقيق موازنة بتُ حق الأفراد في الطعن بإلغاء القرارات الإدارية غتَ ابؼشروعة، مقابل ضرورة خلق الضمانات الكفيلة في مواجهة الإدارة وما تكتسيو القرارات الصادرة عنها من طبيعة تنفيذية، وذلك بغماية مراكزىم من أضرار قد تتًتب ويستحيل تداركها والنابذة عن تنفيذ تلك القرارات خلال ابؼدة التي يتطلبها الفصل في دعوى الإلغاء. وحتى بوقق ىذا النظام فعاليتو ابؼ رجوة لا بد من تنظيم أحكامو بالشكل الذي يتماشى مع طبيعتو الاستعجالية، خاصة مع ما بوملو ىذا الإجراء من ضرورة تقرير بضاية مستعجلة، وقائية ومؤقتة بؼراكز وحقوق الأفراد، وبالرجوع إلى ابؼشرع ابعزائري بجده قد نظم أحكام وقف التنفيذ بدوجب قانون الإجراءات ابؼدنية والإدارية حيث ضبط ىذا الإجراء بحملة من الشروط والإجراءات الواجب احتًامها واتباعها.
