جريمة خيانة الأمانة في التشريع الجزائري

Abstract

تتناول هذه الدراسة موضوع جريمة خيانة الأمانة في التشريع الجزائري، مُركزةً على الأبعاد القانونية والاجتماعية لهذه الجريمة. وتهدف الدراسة إلى تحليل النصوص القانونية المنظمة لجريمة خيانة الأمانة، وتحديد شروط وقوعها، والأدلة اللازمة لإثباتها. كما تستعرض العقوبات المقررة لهذه الجريمة وأثرها على المجتمع. ويعتمد البحث على تحليل القوانين الجزائرية ذات الصلة، بالإضافة إلى استعراض الأحكام القضائية والتطبيقات العملية. وتهدف الدراسة إلى تسليط الضوء على التحديات التي تواجه تطبيق القانون في هذا المجال، وبيان الأثر الرادع للعقوبات المفروضة. وتخلص الدراسة إلى أن جريمة خيانة الأمانة تُشكل تهديدًا للثقة بين الأفراد والمؤسسات، مما يستدعي تكثيف الجهود التشريعية والقضائية لمكافحتها. وتختتم الدراسة بمجموعة من التوصيات لتعزيز فاعلية القانون في مواجهة هذه الجريمة من خلال تطوير النصوص القانونية، ورفع الوعي المجتمعي بخطورة هذه الأفعال. This study addresses the topic of the crime of breach of trust in Algerian legislation, focusing on the legal and social dimensions of this crime. The study aims to analyze the legal texts governing breach of trust, identify the conditions for its occurrence, and the evidence required to prove it. It also reviews the penalties prescribed for this crime and its impact on society. The research relies on analyzing relevant Algerian laws, as well as reviewing judicial rulings and practical applications. The study aims to highlight the challenges faced in the application of the law in this field and to demonstrate the deterrent effect of the imposed penalties. The study concludes that the crime of breach of trust poses a threat to the trust between individuals and institutions, necessitating enhanced legislative and judicial efforts to combat it. The study concludes with a set of recommendations to enhance the effectiveness of the law in confronting this crime by improving legal texts and raising societal awareness about the seriousness of these acts.
