تحقيق التسوية والمطابقة البنايات في ظل القانون 08 / 15

Abstract

لما للبناء من أهمية بالغة في حياة الإنسان، ومرجع لتحقيق رفاهيته واستقراره، ولتحقيق هذا الهدف، لا بد من احترام القواعد القانونية التي تنظم المعايير اللازمة لتحقيق شروط بناء تحفظ معايير السلامة، وتتجنب أي خطر أو عيب قد يُسبب ضررًا أو حوادث تهدد سلامة الأفراد أو الأجهزة، وتفادي أي خسارة محتملة في الأرواح. وقد تأكد ذلك من خلال انتشار المباني العشوائية المبنية على الأراضي الخاصة، والأراضي الفلاحية، وحتى المناطق الأثرية، وتأثيرها المباشر والسلبي على البيئة، وتشويهها للطابع الجمالي للمباني، ومخالفتها للمعايير الهندسية للمباني. وللحفاظ على هذه المعايير، أصدر المشرع الجزائري القانون رقم 08/15، الذي ينظم قواعد مطابقة المباني وإتمام إنجازها، وذلك لتجنب المخاطر المحتملة التي تُشكلها المباني غير الخاضعة للرقابة. في ضوء القواعد العامة والأحكام القانونية المنظمة للبناء على التراب الجزائري، ورغم إصدار المشرع الجزائري للقانون رقم 08/15، إلا أنه لم يحقق النتائج المرجوة منه، وذلك لضيق الوقت من جهة، ولجهل المواطنين بمضمون القانون، وتسوية المباني وتمردها من جهة أخرى.

Considering that construction is of paramount importance in human life and a point of reference for the achievement of human well- being and stability, and in order to achieve this objective, we must respect the legal norms that regulate the standards necessary to achieve building conditions that preserve safety standards and to avoid any danger or defect that may cause harm or accidents to the safety of individuals or organs and to avoid any possible loss of life. This has been confirmed by the proliferation of chaotic structures built on private land, peasant land and even archaeological areas, their direct and negative impact on the environment, their distortion of the aesthetic nature of buildings and the violation of the engineering standards of buildings. In order to preserve these standards, the Algerian legislature promulgated Act No. 08/15, which regulates the rules for the conformity of buildings and the completion of their completion in order to avoid the potential dangers posed by uncontrolled buildings. In the light of the general rules and legal provisions governing the construction of Algerian territory, although the Algerian legislature has promulgated Act No. 08/15, it has not achieved the desired results from the lack of time on the one hand and the ignorance of the citizens of the content of the Act, the settlement of buildings and their rebellion on the other.
