Abstract

تُعد الأسرار التجارية من العناصر الأساسية للعديد من الشركات الأجنبية، مما يمنحها ميزة وسمعة تجارية في مواجهة الشركات والمشاريع المنافسة الأخرى، وتتزايد أهميتها على المستوى الدولي، حيث تُعتبر المحور الرئيسي في عمليات نقل التكنولوجيا، وخاصة بعد إنشاء منظمة التجارة العالمية، إذ يُفضل العديد من منتجي التكنولوجيا الحفاظ على سرية اختراعاتهم وعدم إفشائها، والاستفادة من الحماية التي توفرها قوانين حماية الأسرار التجارية. وقد أصدر المشرع الجزائري ضمانة جديدة لحماية حقوق الملكية الفكرية للمستثمر الأجنبي بعد التعديلات التي طرأت على قانون الاستثمار في المرحلة الأخيرة 22-18. وتُعتبر هذه الإضافة مميزة بالنظر إلى أهمية هذا الحق للمستثمر الأجنبي، ومن هنا يتضح أن المشرع الجزائري وفر الحماية للأسرار التجارية من خلال... حمايته لحقوق الملكية الفكرية.
