النظام القانوني للسلطة العليا للشفافية والوقاية من الفساد ومكافحته

Abstract

لقد إنتهجت الجزائر في الآونة الأخيرة إلى إنشاء العديد من الآليات الرقابية لمواجهة الفساد و هذا تجسيدا للإتفاقيات الإقليمية و الدولية التي أبرمتها ، و هو ما دفعها إلى إستحداث السلطة العليا للشفافية والوقاية من الفساد ومكافحته بموجب القانون القانون 22 - 08 و هذا تلبية لتحقيق أعلى مؤشرات النزاهة و الشفافية لتسيير الشؤون العمومية من خلال توسيع الآليات الرقابية حيث أصبحت السلطة العليا تتولى التح ريات الإدارية و المالية و طلب التوضيحات خاصة التحريات المالية في مظاهر الإثراء غير المشروع للموظف العمومي. كما يحق لأي شخص طبيعي أو معنوي إخطار السلطة العليا عند تواجد معلومات أو معطيات تتعلق بأفعال الفساد كما يمكنها معاينة من تلقاء نفسها وجود إنتهاك الجودة و فعالية إجراءات مكافحة الفساد المطبقة داخل الهيئات و الإدارات العمومية و الجمعيات و المؤسسات و أصبح للسلطة دور أوسع من خلال التدابير التحفظية التي أصبحت تقوم بها و التي ليس لها حق إصدار الأمر المتعلق بها ،بل يتم الإصدار من طرف محكمة سيدي امحمد. In recent times, Algeria has adopted several regulatory mechanisms to combat corruption, in line with regional and international agreements it has signed. This has led to the establishment of the High Authority for Transparency, Prevention, and Fight against Corruption under Law 22-08. The purpose is to achieve the highest levels of integrity and transparency in the management of public affairs by expanding oversight mechanisms. The High Authority now carries out administrative and financial investigations and can request clarifications, particularly in cases related to illicit enrichment of public officials. Any individual or legal entity is entitled to notify the High Authority of any information or data related to corrupt practices. It also has the authority to investigate and assess the effectiveness of anti-corruption measures implemented within public bodies, associations, and institutions. The High Authority now plays a broader role through the precautionary measures it can take, although it does not have the authority to issue related orders. Instead, such orders are issued by the Court of Sidi M'hamed.
