Abstract
تعد الامتيازات الجبائية الركيزة التشريعية الأساسية لتوجيه السياسة الاقتصادية للدولة وحماية نسيجها الاستثماري، حيث تمثل انحرافاً قانونيا مقصودا عن القواعد الضريبية العامة ،بهدف إيجاد توازن فعال بين تشجيع المبادرات الاقتصادية وضمان التدفقات المالية، ومع صدور قانون الاستثمار الجديد رقم 22-18، شهد المركز القانوني لهذه الحوافز تطوراً هاماً استهدف ضبط أطرها الإجرائية ضمن أنظمة تحفيزية دقيقة تسري خلال مرحلتي الإنجاز والاستغلال، ليتجاوز هذا الدور النطاق الوطني ويمتد إلى البيئة الدولية عبر شبكة من الاتفاقيات الجبائية المصادق عليها لمنع الازدواج الضريبي وضمان كرامة المعاملات المالية العابرة للحدود. تم تفعيل دور المنظومة المؤسساتية والضبطية لضمان مشروعية تسيير هذه الامتيازات ويظهر ذلك جلياً في بسط الرقابة الصارمة للمجلس الوطني للاستثمار على المشاريع الاستراتيجية الكبرى، وتحديد مكانته في رسم التوجهات العليا، ويمتد هذا المسار القيادي والتنفيذي إلى الوكالة الجزائرية لترقية الاستثمار، التي تحول دورها من مجرد جهاز إداري تقليدي إلى مرافق حقيقي للمستثمر عبر إرساء نظام الشبابيك الوحيدة (الوطنية واللامركزية) مما أسهم في تذليل العقبات البيروقراطية وبناء قناعة آمنة لدى المتعاملين الاقتصاديين. هذه الصلاحيات والمزايا المستحدثة على ضبط الإجراءات الأولية امتدت لتشمل دورا حيويا في صياغة واقع الحركة التنموية من خلال التنسيق العالي داخل الشبابيك الوحيدة، أتيحت آليات جديدة تدفع عجلة الاستثمار المباشر عبر تحفيز عمليات الإنشاء والتوسعة وخلق مناصب الشغل، وينتهي هذا المسار الإجرائي المتكامل بتنشيط الاستثمار غير المباشر وتسهيل حركة رؤوس الأموال وإبرام الشراكات، مما يضمن في النهاية انسيابية الخصومة الاقتصادية ضد الركود ويحول المنظومة الجبائية والمؤسساتية إلى حارس حقيقي للشرعية الاستثمارية وحامٍ للاقتصاد الوطني. Les avantages fiscaux constituent le principal fondement législatif permettant d’orienter la politique économique de l’État et de protéger son tissu d’investissement. Ils représentent une dérogation juridique intentionnelle aux règles fiscales générales visant à établir un équilibre efficace entre l’encouragement des initiatives économiques et la garantie des recettes financières. Avec l’entrée en vigueur de la nouvelle loi sur l’investissement n° 22-18, le régime juridique de ces incitations a connu une évolution significative à travers l’encadrement de leurs procédures au sein de systèmes d’incitation précis applicables durant les phases de réalisation et d’exploitation des projets. Ce rôle dépasse désormais le cadre national pour s’étendre à l’environnement international grâce à un réseau de conventions fiscales ratifiées destinées à prévenir la double imposition et à assurer la sécurité des transactions financières transfrontalières. Le rôle du système institutionnel et réglementaire a été renforcé afin de garantir la légalité de la gestion de ces avantages. Cela se manifeste notamment par le contrôle rigoureux exercé par le Conseil National de l’Investissement sur les grands projets stratégiques et par sa contribution à l’orientation des politiques d’investissement. Cette dynamique se poursuit également au niveau de l’Agence Algérienne de Promotion de l’Investissement, dont le rôle a évolué d’un simple organisme administratif vers un véritable accompagnateur de l’investisseur grâce à la mise en place du système des guichets uniques (nationaux et décentralisés), contribuant ainsi à réduire les obstacles bureaucratiques et à renforcer la confiance des opérateurs économiques. Ces nouvelles prérogatives et avantages ne se limitent pas à l’encadrement des procédures préliminaires, mais participent également à la dynamique du développement économique à travers une coordination efficace au sein des guichets uniques. De nouveaux mécanismes ont été instaurés afin de stimuler l’investissement direct par l’encouragement des opérations de création et d’extension des projets ainsi que par la création d’emplois. Ce processus intégré favorise également l’investissement indirect, facilite la circulation des capitaux et la conclusion de partenariats, garantissant ainsi une meilleure fluidité de l’activité économique face aux risques de stagnation et faisant du système fiscal et institutionnel un véritable garant de la légalité de l’investissement et de la protection de l’économie nationale. . Tax incentives constitute the primary legislative foundation for directing the State’s economic policy and protecting its investment environment. They represent a deliberate legal deviation from general tax rules aimed at achieving an effective balance between encouraging economic initiatives and ensuring financial revenues. With the enactment of the new Investment Law No. 22-18, the legal framework governing these incentives underwent significant development through the establishment of precise incentive schemes applicable during both the implementation and operational phases of investment projects. This role has expanded beyond the national level to the international sphere through a network of ratified tax treaties designed to prevent double taxation and ensure the security of cross-border financial transactions. The role of the institutional and regulatory framework has been strengthened to ensure the lawful management of these incentives. This is reflected in the strict supervision exercised by the National Investment Council over major strategic projects and its contribution to defining higher investment orientations. This leadership and implementation process also extends to the Algerian Investment Promotion Agency, whose role has evolved from that of a traditional administrative body into a genuine facilitator for investors through the establishment of one-stop shops (national and decentralized), thereby reducing bureaucratic obstacles and enhancing the confidence of economic operators.
