المسؤولية الجنائية للشاهد في التشريع الجزائري

Abstract

تعد شهادة الشاهد من أهم الأدلة التي يعتمد عليها القاضي في تحديد وجهة الحكم وبناء قناعته وإصدار الحكم، ومن ثم تحقيق العدالة، فالشاهد له مركز قانوني عام في الدعوى العمومية وقد خصص له المشرع الجزائري جملة من الواجبات والالتزامات تقع على عاتقه، وأقر له مجموعة من الحقوق يتمتع بها ومن هنا فالشاهد تلقى عليه مسؤولية جنائية في حالة امتناعه أو إخلاله بالالتزامات المفروضة عليه، ويتعرض لعقوبات جزائية حددها المشرع في قانون العقوبات وقانون الإجراءات الجزائية، ومن أهم حالات الإخلال بالالتزامات المفروضة على الشاهد شهادة الزور، التي أقر لها المشرع الجزائري عقوبات صارمة.

The witness's testimony is considered one of the most important pieces of evidence that the judge relies on in determining the direction of the ruling, building his conviction, issuing the ruling, and then achieving justice. The witness has a general legal status in the public lawsuit, and the Algerian legislator has allocated to him a set of duties and obligations that fall upon him, and has approved for him a set of rights. He enjoys it. Hence, the witness is subject to criminal liability in the event that he abstains or breaches the obligations imposed on him. He is exposed to criminal penalties specified by the legislator in the Penal Code and the Code of Criminal Procedure. One of the most important cases of breach of the obligations imposed on the witness is false testimony, for which the Algerian legislator has approved strict penalties.
