التحقيق الجنائي للجرائم الإلكترونية وإثباتها في التشريع الجزائري

Abstract

تشكل الجرائم الإلكترونية تحديا أمنيا كبيرا يواجه المجتمع الدولي نظرا لتعقديها واستخدامها لتقنيات حديثة ومتطورة من قبل مجرمين يتمتعون بذكاء وخبرة عاليتين، مما يصعب عمليات التحقيق والإثبات، بحيث أن الصورة التقليدية لإجراءات التحقيق التي تقوم بها الجهات المكلفة بالبحث والتحري عن الجريمة لا تتماشى مع طبيعة الجرائم الإلكترونية.ولمواجهة هذا التحدي أدخل المشرع الجزائري تعديلات على قانون الإجراءات الجزائرية سنة 2006 الذي جاء بآليات التحري الخاصة للتحقيق في الجرائم الإلكترونية، ثم كرس المشرع الجزائري بموجب القانون رقم09-04 المتعلق بالجرائم المتصلة بتكنولوجيات الإعلام والإتصال ومكافحتهما، والذي يعد أول قانون إجرائي خاص بمكافحة الجرائم الإلكترونية. ونهدفمن خلال دراستنا هذه، إلى تسليط الضوء على أهم أساليب التحقيق والكشف عن الجرائم الإلكترونية التي أقرها المشرع الجزائري ومدى فعاليتها في ضبط وإثبات هذا النوع من الجرائم.

Cybercrimes pose a major security challenge to the international communit due to their complexity and the use of advanced and sophisticated technologies by criminals who possess high intelligence and expertise.Which makes from of investigation and proof difficult so that the traditional from of investigation price duress carried out outdy the authorities in charge of research and investigation of crime is not in line with the nature of cy dercrime. To face the challenge the Algerian legislator introduced amendments to the code of criminal procedure in 2006 with introduced special investing attire mechanisms to inirestigate cybercrimes them the Algerian legislator enshrined law 09-04 ancrimes related to information and communication technologies .what is the first procedural law to combat cybercrime. through this study we aim to shed light on the mast important methods of investigation and detection of cybercrime approved by the Algerian legislator and their effectiveness in detecting and proving that type of crime. .
