النظام القانوني للتجارة الإلكترونية في ظل التشريع الجزائري

Abstract

يعتبر موضوع التجارة الإلكترونية من المواضيع التي أحدثت جدلا كبيرا وذلك نظرا لأهميتها البالغة إذ سهلت عملية التواصل وقربت المسافات بين الدول من كافة أنحاء العالم، كما ظهرت نتيجة لتطور وسائل الاتصال وتكنولوجيا المعلومات. ىذا ما دفع بالمشرع الجزائري إلى البحث عن إطار قانوني يضبط وينظم مختلف المعاملات التي تتم بواسطتها، حيث تمحورت ىذه الدراسة حول النظام القانوني للتجارة الإلكترونية في ظل التشريع الجزائري وذلك من خلال تبيان مفهومها، خصائصها وكذا عيوبها ومزاياىا، كما تم التطرق إلى تكوين وتنفيذ العقد الإلكتروني إضافة إلى طرق إثباتو، وتعرضنا إلى وسائل الدفع الإلكترونية.

summary The issue of e-commerce is considered one of the topics that has caused great controversy due to its extreme importance, as it has facilitated the process of communication and brought closer distances between countries from all over the world, and it has also emerged as a result of the development of means of communication and information technology. This is what prompted the Algerian legislator to search for a legal framework that controls and regulates the various transactions that take place through it. This study focused on the legal system for electronic commerce under Algerian legislation, by clarifying its concept, characteristics, as well as its disadvantages and advantages. The formation and implementation of the electronic contract was also addressed. In addition to ways to prove it, we were exposed to electronic payment methods.
