Abstract
تناولت هذه الدراسة الإطار القانوني والوظيفي للوكالة الجزائرية لترقية الاستثمار في ظل القانون رقشم22-18، وبيان فعاليتها في تحسين مناخ الأعمال واستقطاب الرساميل. وتوصلت الدراسة إلى أن المشرع الجزائري قد خطى خطوات حاسمة نحو تكريس حرية الاستثمار وعصرنة المرفق الاقتصادي؛ من خلال إلحاق الوكالة بالوزير الأول، واستبدال التراخيص المسبقة بنظام "التصريح والتسجيل الفوري" عبر الشبابيك الوحيدة، وتفعيل المنصة الرقمية كآلية لضمان الشفافية وتسيير الامتيازات الجبائية. كما برز الدور الاستراتيجي للوكالة بعد منحها بموجب القانون 23-17الحصرية المطلقة في تسيير ومنح العقار الاقتصادي التابع للدولة بصيغة الامتياز بالتراضي بالتكامل مع مصالح أملاك الدولة والجماعات المحلية. ورغم هذه المكاسب، لا يزال الميدان يواجه تحديات ترتبط ببطء التنسيق الميداني وعدم مسايرة المنظومة المصرفية للثورة الرقمية. وعليه، أوصت الدراسة بضرورة تعميق الاستقلالية الإدارية للوكالة، وتوسيع الربط الرقمي البيني بين القطاعات، وإصلاح النظام المالي عبر إنشاء بنوك استثمارية متخصصة لضمان الاستقرار التشريعي وتأمين بيئة الأعمال.This study examined the legal and functional framework of the Algerian Investment Promotion Agency under Law No. 22-18, assessing its efficacy in enhancing the business climate and attracting capital. The study concluded that the Algerian legislator has taken decisive strides toward consecrating investment freedom and modernizing the economic utility. This was achieved by attaching the agency to the Prime Minister, replacing prior authorizations with an "immediate declaration and registration system" via One-Stop Shops, and deploying the Digital Platform to ensure transparency and manage tax incentives. Furthermore, the agency's strategic role culminated under Law No. 23-17, which granted it exclusive authority over managing and allocating State economic land through mutual agreement concessions, in integration with the State Property Directorate and local authorities. Despite these gains, practical challenges persist regarding delayed field coordination and the banking system's lag behind the digital revolution. Accordingly, the study recommended strengthening the agency's administrative independence, expanding digital interconnectedness across sectors, and reforming the financial system through establishing specialized investment banks to ensure legislative stability and secure the business environment.
