حقوق الأجانب في التشريع الجزائري

Abstract

انطلاقا من التزاماتها الدولية المتعلقة بحقوق الانسان والتي ترتكز على مبدأ المساواة في الحقوق دون تمييز بسبب الجنس، اللون، العرق، الدين، تعترف الجزائر للأجانب المحددين في أحكام القانون رقم 08-11 المتعلق بشروط دخول الأجانب للجزائر واقامتهم بها وتنقلهم، بحقوق مماثلة للحقوق المعترف بها للمواطنين، لكن نطاق هذه الحقوق لا يمتد إلى فئة الحقوق السياسية، كما أن بعض الحقوق المعترف بها للأجانب في التشريع الجزائري مقيدة بشكل أضيق من الحقوق المعترف بها للمواطنين والتي تبررها اعتبارات الأمن الوطني وحماية المصلحة العامة، وهي قيود يسمح بها القانون الدولي لحقوق الانسان لمصلحة الدولة مقابل ت آليات وطنية ودولية تكفل حماية حقوق الأجانب.

Based on its international human rights commitments, which are grounded in the principle of equality of rights without discrimination based on gender, color, race, or religion, Algeria recognizes rights for foreigners specified in the provisions of Law No. 08-11, concerning the conditions of entry, residence, and movement of foreigners in Algeria, that are similar to the rights recognized for citizens. However, the scope of these rights does not extend to political rights. Additionally, some of the rights recognized for foreigners in Algerian legislation are more narrowly restricted compared to those recognized for citizens, justified by considerations of national security and the protection of public interest. These restrictions are permitted under international human rights law in favor of the state, in exchange for national and international mechanisms that ensure the protection of foreigners' rights.
