المعیار العضوي كأساس لاختصاص القضاء الإداري في الجزائر

Abstract

يعد المعيار العضوي من أهم المعايير التي يعتمد عليها القضاء الإداري في الجزائر لتحديد اختصاصه. يستند هذا المعيار إلى صفة الجهة الإدارية المعنية ﺑﺎلنزاع، بغض النظر عن طبيعة النشاط الإداري الذي أدى إلى النزاع. بموجب المادة 800 من قانون الإجراءات المدنية والإدارية، يعتمد القضاء الإداري الجزائري على المعيار العضويكقاعدة عامة حيث يتم إعتبار النزاع إداريا إذا كان أحد أطرافه شخصا من أشخاص القانون مما يخول المحاكم الإدارية صلااحية الفصل فيه . مع ذلك، هناك استثناءات لهذه القاعدة، حيث توجد بعض الحالات التي يتم فيها توزيع الاختصاص بناء على معايير أخرى، كما ورد في قوانين خاصة متعددة وقانون الإجراءات المدنية والإدارية نفسه.

The organic criterion is one of the most important criteria on which the administrative judiciary in Algeria relies to determine its jurisdiction. This criterion is based on the status of the administrative body involved in the dispute, regardless of the nature of the administrative activity that led to the dispute. Under Article 800 of the Code of Civil and Administrative Procedure, the Algerian administrative judiciary relies on the organic criterion as a general rule, whereby a dispute is considered administrative if one of its parties is a person of public law, giving the administrative courts jurisdiction over it. However, there are exceptions to this rule, as there are some cases where jurisdiction is allocated based on other criteria, as stipulated in various special laws and the Code of Civil and Administrative Procedure itself.
