جريمة اختطاف الاطفال في التشريع الجزائري

Abstract

ظاهرة اختطاف الأطفال ليست مستحدثة، بل هي من الجرائم المتأصلة تاريخياً، ومع ذلك تشير الملاحظات الحديثة إلى تزايد ملحوظ في معدلات انتشارها وتداعياتها، مما يمنحها أهمية بالغة على مستويات متعددة، يرجع هذا التفاقم الى ارتفاع عدد الحالات المسجلة وما يصاحبها من اعتداءات جسيمة، قد تصل الى إزهاق الروح. وقد دفع هذا الانتشار الخطير للجريمة بالجزائر الى اتخاذ مجموعة من الاجراءات القانونية والمؤسساتية للحد من هذه الظاهرة، حيث تشمل تعديل قانون العقوبات واستحداث قانون جديد رقم 20/15، المتعلق بالوقاية من جرائم اختطاف الاشخاص ومكافحتها، وتشديد العقوبات المرتبطة بهذه الجريمة، اضافة الى ذلك تم تفعيل دور الاجهزة الامنية وانشاء وحدات متخصصة بالأحداث في خطر ضمن قانون 15/12، وتضطلع مؤسسات المجتمع المدني ووسائل الاعلام بدور تكميلي في تشر الوعي ورفع مستوى التحسيس بخطورة هذه الظاهرة. The phenomenon of child abduction is not recent; rather, it is one of thehistorically deep-rooted crimes. Nevertheless, modern observations indicate a notable increase in its prevalence rates and repercussions, giving it paramount importance on multiple levels. This escalation has led to a rise in the number of registered cases and the accompanied severe assaults, which may even amount to the loss of life. This dangerous spread of the crime in Algeria has prompted the adoption of a set of legal and institutional measures to curb this phenomenon. These include amending the Penal Code and introducing a new Law N° 20-15 concerning the prevention and combating of kidnapping crimes, alongside hardening the penalties associated with this crime. Additionally, the role of security agencies has been activated, and specialized institutions for juveniles at risk have been established under Law N° 15-12. Furthermore, civil society organizations and the media play a complementary role in spreading awareness and raising the level of sensitization regarding the gravity of this phenomenon.
