دور وسيط الجمهورية في حماية الحقوق والحريات

Abstract

أعاد المرسوم الرئاسي رقم20-45 ظهور هيئة وسيط الجمهورية من جديد بعد ما تم إلغائه سنة1999 وقد جاءت هذه الهيئة في ظل محيط سياسي واقتصادي وإجتماعي جديد فهي هيئة موضوعة لدى رئيس الجمهورية وتستمد سلطتها منه، الهدف منها المساهمة في حماية حقوق المواطنين وحرياتهم والنظر في قانونية سير المرافق العمومية في إطار الحكامة الجيدة والشفافية للقضاء على مظاهر البيروقراطية والفساد الإداري الذي ساد لفترة من الزمن، وبذلك يكون المشرع الجزائري قد أدخل نظاما رقابيا جديدا يساير بذلك الأنظمة الرقابية العالمية استلهمها من النموذج الفرنسي المتأثر بالنموذج السويدي، حيث تلعب هذه الهيئة دور الرابط البديل بين الإدارة والمواطن و أن تسعى لحماية حقوق وحريات المواطنين، لذلك اعطى لها المرسوم مكانة هامة من خلال تنظيمها، مما جعلها هامة في مجال قريبة جدا من المواطنين، كما اعتبرها هيئة طعن غير قضائية تتمتع بإختصاصات هامة في مجال ا بشروط التحري والإخطار، غير أن تبعيتها المطلقة لرئيس الجمهورية وتقييد بعض من صلاحياتها بشروط وتقليص مجال تدخلها، أنقص من دورها في صيانة الحقوق والحريات

Thus, the algerian legislator has introduced a new supervisory system that heralds the global regulatory systems. It was inspired by the french model influenced by the swedish model, where this body plays the role of the alternative link between the administration and the citizen and that sought to protect the rights and freedoms of citizens, so the decree gave it an important position through its organization, which made it very close to the citizens as expressed by these seven non-judicial appeals with important powers in the field of maritime and notification expressing its absolute curse to the president of the republic and the hand of some of the its powers are subject to conditions and the reduction of its income reduces its role in the case of rights.
