Abstract
تتناول هذه المذكرة موضوع "وسائل الإثبات التقليدية والحديثة في المادة المدنية" في ظل التشريع الجزائري، وتهدف إلى بيان الإطار القانوني للإثبات وتحليل مدى نجاح المشرع الجزائري في التوفيق بين وسائل الإثبات الكلاسيكية والتطورات التكنولوجية المعاصرة. انطلقت الدراسة من إشكالية رئيسية تتمحور حول مدى استيعاب المشرع للوسائل الحديثة (كالكتابة والتوقيع الإلكترونيين) إلى جانب الوسائل التقليدية (الكتابة، الشهادة، القرائن، اليمين، والإقرار). وللإجابة عن ذلك، اعتمدت الدراسة على المنهج الوصفي التحليلي لعرض النصوص القانونية وتحليلها، بالإضافة إلى المنهج المقارن في بعض المواضع. خلصت الدراسة إلى أن المشرع الجزائري تبنى مذهباً مختلطاً في الإثبات، ونجح نسبياً في مواكبة التحول الرقمي من خلال إقرار الكتابة الإلكترونية بموجب القانون 05-10 والتوقيع والتصديق الإلكترونيين بموجب القانون 15-04، مكرساً بذلك مبدأ التكافؤ الوظيفي بين الورقي والإلكتروني. إلا أن هذا التوفيق لا يزال منقوصاً بسبب تشتت النصوص القانونية، وغياب إطار قانوني خاص ينظم وسائل تكنولوجية أخرى (كالتسجيلات الصوتية والمرئية، والرسائل النصية، ومحادثات التواصل الاجتماعي)، مما يتركها لتقدير القاضي كقرائن قضائية. أوصت الدراسة بضرورة إصدار قانون شامل وموحد للإثبات الإلكتروني، وتطوير البنية المؤسسية للتصديق الإلكتروني، وتفعيل دور الخبرة المعلوماتية وتأهيل الخبراء This thesis examines the topic of "Traditional and Modern Means of Proof in Civil Matters" under Algerian legislation, aiming to clarify the legal framework of proof and analyze the extent to which the Algerian legislator has succeeded in reconciling classic evidentiary methods with contemporary technological advancements. The study addresses a primary problematic regarding the legislator's capacity to integrate modern means (such as electronic writing and signatures) alongside traditional ones (writing, testimony, presumptions, oath, and confession). To answer this, the research utilized a descriptive-analytical approach to present and analyze legal texts, alongside a comparative approach where necessary. The study concluded that the Algerian legislator adopted a mixed doctrine of proof and has relatively succeeded in keeping pace with the digital transformation by recognizing electronic writing through Law 05-10, and electronic signatures and certification through Law 15-04, thereby enshrining the principle of functional equivalence between paper and electronic documents. However, this harmonization remains incomplete due to the fragmentation of legal texts and the absence of a specific legal framework regulating other technological means (such as audio/video recordings, SMS, and social media conversations), leaving them to the judge's discretion as judicial presumptions. The study recommended enacting a comprehensive and unified law for electronic proof, developing the institutional infrastructure for electronic certification, and enhancing the role of IT expertise.
