الرقابة القضائية على أعمال مجلس المنافسة في التشريع الجزائري

Abstract

لقد منح لمجلس المنافسة مجموعة من الصلاحيات والاختصاصات، وتم تزويده بمختلف الوسائل والآليات للقيام بدوره فيما يتعلق بمراقبة اقتصاد السوق، وتجنبا لتجاوز السلطة عند ممارسة مجلس المنافسة لمهامه، فقد أقر المشرع الجزائري أن الضامن لحماية حقوق المؤسسات في مواجهة مجلس المنافسة هو القضاء باعتباره الساهر على مراقبة تطبيق القانون. تهدف هذه الدراسة المعالجة لموضوع الرقابة القضائية على أعمال مجلس المنافسة في التشريع الجزائري إلى تسليط الضوء على الطبيعة القانونية لمجلس المنافسة، والهيئات القضائية المختصة بممارسة الرقابة على أعمال هذا الأخير. Le conseil de la concurrence s’est vu attribuer un ensemble de pouvoirs et de compétences, et il a été doté de divers moyens et mécanismes pour jouer son rôle en matière de surveillance de l’économie de marché, et afin d’éviter les abus de pouvoir lorsque de conseil de la concurrence exerce ses fonctions, le législateur algérien a reconnu que le garant de la protection des droits des institutions face au conseil de la concurrence est la pouvoir judiciaire, car il est vigilant sur le contrôle de l’application des lois. Cette étude, traitant de la question du contrôle juridictionnel des travaux du conseil de la concurrence dans la législation algérienne, vise a faire la lumière sur la nature juridique du conseil de la concurrence, et les instances judiciaires compétentes pour exercer un contrôle sur les travaux de ce dernier.
