الإختصاص القضائي في نظام الإفلاس والتسوية في الجزائر

Abstract

يعتبر الإختصاص القضائي أحد الشروط الشكلية لتطبيق نظام الإفلاس والتسوية القضائية وذلك لضمان حسن سير المعاملات التجارية من خلال تحديد الجهة القضائية المختصة نوعيا من جهة، وتحديد الإختصاص الإقليمي والشامل للمحكمة التجارية المتخصصة في دعاوى الإفلاس من جهة أخرى، وهذا مانظمه المشرع الجزائري في قانون الإجراءات المدنية والإدارية المعدل والمتمم. ويقصد بالإختصاص تحديد المحكمة المختصة بالفصل في منازعات الإفلاس والتسوية القضائية التي يتم إنهائها بالصلح القضائي كطريق بديل لحل هذه نزاعات، وذلك بهدف دعم الإقتصاد الوطني .

Jurisdiction is one of the formal conditions for the application of the bankruptcy and judicial settlement system. It ensures the proper conduct of commercial transactions by determining the court's jurisdiction both in terms of subject matter and regional and overall competence of the specialized commercial court in bankruptcy cases. This is regulated by the Algerian legislator in the amended and supplemented Civil and Administrative Procedures Law. Jurisdiction refers to identifying the court competent to resolve bankruptcy and judicial settlement disputes, which can be concluded through judicial conciliation as an alternative method of dispute resolution, aiming to support the national economy.
