المسؤولية القانونية عن الجرائم البنكية

Abstract

تُعد المسؤولية القانونية للبنك عن جرائمه من المواضيع المهمة في القانون الجنائي والاقتصادي، إذ يُمكن أن يُساء استخدام المؤسسات المصرفية في ارتكاب جرائم مثل تبييض الأموال، والاخلال بالسرية المصرفية، فيتحمل البنك المسؤولية الجنائية إذا ثبت أن الجريمة وقعت بفعل موظفيه أثناء أداء مهامهم وباسم المؤسسة وحيابه، كما يساءل البنك مدنيا خاصة على تقصير في أنظمة الرقابة أو تواطؤها، فتتخذ هذه المسؤولية شكل المسؤولية المباشرة، في حال ثبت علم البنك أو أحد مسؤوليه بالجريمة، أو المسؤولية غير المباشرة نتيجة الإهمال في تطبيق قوانين الامتثال والشفافية او نتج عن الجريمة اخلال بالالتزامات التعاقدية، وتُفرض على البنك في هذه الحالة عقوبات أصلية تتمثل في الغرامات المالية، اضافة الى سحب التراخيص، كما يجوز مساءلة الأفراد المسؤولين داخل البنك جنائيا ومدنيا.

The legal liability of a bank for its crimes is considered one of the important topics in criminal and economic law. Banking institutions can be misused to commit crimes such as money laundering and breaches of banking secrecy. The bank bears criminal liability if it is proven that the crime was committed by its employees during the performance of their duties, in the name of and on behalf of the institution. The bank may also be held civilly liable, particularly for shortcomings in oversight systems or complicity. This liability takes the form of direct liability if it is proven that the bank or one of its officials was aware of the crime, or indirect liability as a result of negligence in applying compliance and transparency laws, or if the crime leads to a breach of contractual obligations. In such cases, the bank may face primary penalties such as financial fines, as well as the revocation of licenses. Additionally, individuals responsible within the bank may also be held criminally and civilly accountable.
