الرقابة على اعمال البناء في التشريع الجزائري

Abstract

يُعد موضوع الرقابة العمرانية من المواضيع التي حظيت باهتمام المشرع، ويتجلى ذلك في إصداره قانون التطوير والتعمير وتتمثل هذه الرقابة في وضع آليات رقابية متعددة على أعمال البناء، وتنقسم إلى رقابة أولية باستخدام الأدوات والشهادات والتراخيص المتعلقة بالتخطيط والبناء، ورقابة لاحقة، حيث أُنشئت هيئات خاصة لرصد المخالفات العمرانية وتحرير المحاضر اللازمة واتخاذ الإجراءات القضائية اللازمة في حال وقوعها. The issue of urban control is one of the topics that has received attention from the legislator, as evidenced by his issuance of the Development and Reconstruction Law. This control lies in the appointment of several control mechanisms on construction work, and is divided into a preliminary control by using tools, certificates and licenses related to planning and construction, while the second control is a post-control, for which special bodies have been established to monitor urban violations, write reports and take the necessary judicial measures in the event of a violation.
