الصناعات الصيدلانية بين قواعد الممارسات التجارية وقانون المنافسة

Abstract

تلعب الصناعات الصيدلانية دورا حاسما في الحفاظ على الصحة العامة، كما تعمل على تطوير وإنتاج الدوية والمنتجات الصيدلانية الخرى التي تساهم في علاج المراض، لذلك خصها المشرع بضوابط صارمة لإنتاجها وعرضها في السوق الصيدلاني نظرا لخصوصيتها. تخضع الصناعات الصيدلانية لقاعدة الاحتكار الصيدلاني، إلا انه وبالرغم من ذلك فهي خاضعة لضوابط قانونية تبسط رقابتها على هذا النوع من الصناعات، وتقرر عقوبات للمخالفات التي ترتكبها. تهدف هذه الدراسة إلى الإلمام بقواعد المنافسة والممارسات التجارية، المطبقة على الصناعات الصيدلانية والغوص في مدى تَثير هذه القواعد على هذا النوع من الصناعات، ومدى تطبيقها في الواقع العملي من طرف المؤسسات الصيدلانية.

The pharmaceutical industry is essential to preserving public health. In addition, they design and manufacture pharmaceutical items and other medications that aid in the treatment of illnesses. Because of their specificity, the legislator has imposed stringent regulations on their production and display in the pharmaceutical industry. Pharmaceutical monopolies govern the pharmaceutical businesses. They are, nevertheless, subject to legislative restrictions that limit their authority over this kind of business and specify the consequences for any infractions they may commit. This study aims to become familiar with competitions rules and commercial practices applied to the pharmaceutical industry and delve into to which these rules effect this types of industries and the extent of their application in practices by pharmaceutical institutions.
