ييُعد الذكاء الاصطناعي أحد أبرز التحولات التقنية التي شهدها البشر في العصر الحديث؛ إذ تطور سياقه التاريخي من مجرد أفكار فلسفية ونماذج رياضية أولية ليصبح ركيزة أساسية في قيادة الثورة الصناعية الرابعة. وتكمن أهميته في كونه وسيلة فعالة لإنجاز مهام متعددة تتطلب ذكاءً يحاكي الذكاء البشري، فضلاً عن قدرته على التعلم الذاتي المستمر -وهي إحدى أهم سماته- وتطبيقاته الواسعة في مجالات شتى كالطب والتعليم والصناعة وغيرها. ومع ذلك، لم يحل ذلك دون ظهور ممارسات قد تلحق الضرر بمستخدمي هذه التقنية الحديثة، مما استدعى النظر في مدى تحمل الذكاء الاصطناعي للمسؤولية المدنية عن أفعاله؛ وهي مسألة أفرزت تحديات تشريعية وصعوبات في تطبيق قواعد المسؤولية التقليدية عليه، لا سيما فيما يتعلق بتحديد الفاعل المسؤول وإثبات الخطأ وعلاقة السببية. وهذا يتطلب تطويراً قانونياً يحقق توازناً بين تشجيع الابتكار وضمان الأمن والاستقرار التشريعي. Its importance lies in the fact that it is considered an effective means of accomplishing many multiple tasks that require intelligence that mimics humans, in addition to its ability to continuously self-learn, which is one of its most important features Not to mention its wide applications in various fields such as medicine, education, industry, etc., but that did not prevent the emergence of actions that could cause harm to users of this modern technology, which made it necessary to consider the extent to which this artificial intelligence bears civil responsibility for its actions, which witnessed legislative challenges and difficulties in applying traditional liability rules to it, especially with regard to identifying the responsible actor and proving the error and causal relationship This requires legal development that achieves a balance between encouraging innovation and achieving legislative security and stability.
