الحماية القانونية للمبلغين عن جرائم الفساد في ظل القانون الجزائري

Abstract

عرف العالم بأسره إنتشار واسع لجرائم الفساد، وعلى غرار تلك الدول شهدت الجزائر هذه الظاهرة ما جعلها تسعى لمحاربة الفساد بشتي الطرق والأساليب، وطورت وسائل البحث والتحري التقليدية في الكشف عن الجرائم لاسيما الخطيرة منها. فقد تمحورت دراستنا حول موضوع الإبلاغ الذي تم إعتماده كآلية من آليات مكافحة جرائم الفساد، نظرا للدور الذي يلعبه التبليغ في الكشف عن تلك الآفة. وقد كفل المشرع الجزائري المبلغين بحماية موضوعية وتسليط العقاب على كل من يتعرض لهم . The whole world knew a wide spread of corruption crimes, and like those countries, Algeria witnessed this phenomenon, which made it seek to fight corruption in various ways and methods, and developed traditional research and investigation methods in detecting crimes, especially serious ones. Our study focused on the subject of reporting, which was adopted as a mechanism for combating corruption crimes, given the role that reporting plays in detecting this scourge. The Algerian legislator has guaranteed the whistleblowers with objective protection and punishment for all those who are exposed to them.
