التسييرالتشاركي للجماعات المحلية في التشريع الجزائري

Abstract

ظهر مفهوم الديمقراطية التشاركية في المجتمعات المعاصرة كفكرة حديثة، تهدف إلى حل المشاكل التي ظهرت في الديمقراطية التمثيلية، وذلك من خلال منح المواطن الحق في الحصول على فرص المشاركة والاستشارة ومتابعة المشاريع وتقييمها خاصة على مستوى الجماعات المحلية، كونها القاعدة الأساسية لتفعيل الديمقراطية التشاركية، ويتم تجسيد ذلك بواسطة تهيئة السبل والآليات المناسبة للم واطن في عملية إشراكه في صنع القرار . حيث نص المشرع الجزائري في قانون البلدية رقم 11-10 19 على مجموعة - وقانون الولاية رقم 66 من الآليات التي تهدف إلى إشراك المواطن في عملية صنع القرار على المستوى المحلي، تتمثل في آلية الإعلام بالإضافة إلى آلية الاستشارة . الديمقراطية التشاركية- الجماعات المحلية- الإعلام- الاستشارة The concept of participatory democracy has emerged in contemporary societies as a modern idea, aimed at solving the problems of representative democracy, granting citizens the right to obtain opportunities for participation, consultation, monitoring and evaluation of projects, especially at local government level, being the fundamental basis for activating participatory democracy, and this is achieved by having the means and mechanisms appropriate to the citizen in the process of involving him in decision-making. Thus, the Algerian legislator has provided in Commune Law No. 11-10 and Wilaya Law No. 12-07 for a set of mechanisms aimed at involving the citizen in the decision-making process at the local level, namely the mechanism of information and the mechanism of consultation.
