النظام القانوني للرسوم والنماذج الصناعية في التشريع الجزائري

Abstract

تعتبر الرسوم والنماذج الصناعية واحدة م ن أه م مفردات الملكية الصناعية وهذا راجع لشيوعها في السنوات الأخير ة ، وكذلك لدوره م الهام في مختلف المجالات منها الصناعة والتجارة وتأثيره ا على اقتصاد الدول ،إ ذ نجد أ ن الجزائر سعت لوض ع نظام قانوني خاص بالرسوم والنماذ ج الصناعي ة والذي يحمي أصحابها . لكي تحظى الرسوم والنماذج الصناعية بالحماية اللازمة يجب أ ن تتوفر على مجموعة م ن الشروط الموضوعية ومجموع ة من الشروط الشكلي ة ،كما أنه ا حظيت بالحماية الدولية وهذا يظه ر من خلال الاتفاقيات منها باريس ،لاهاي ولوكارنو التي نظمتها ونصت عليها ،بالإضاف ة إلى الحماية الوطنية وتتمثل في الحماية الجزائية والحماية المدنية .
