Abstract

يعود تاريخ ظهور نظام المثول بناءا على الاعتراف المسبق بالذنب لأول مرة في الدول الأنجلوسكسونية، ثم إنتقل فيما بعد إلى الدول اللاتينية، ليتم تبنيه من طرف الدول العربية منها التشريع الجزائر فهو ليس جديد في التشريعات المقارنة لكنه حديث الولادة في التشريع الجزائري بموجب قانون رقم 25-14 المتضمن قانون الإجراءات الجزائية، فنظام المثول بناءا على الاعتراف المسبق بالذنب سلطة وكيل الجمهورية في إختصار اجراءات المحاكمة بالنسبة لجرائم محددة إما من تلقاء نفسه أو من طرف المتهم أو محاميه بشرط قبول هذا الأخير بالإعتراف بالأفعال المنسوبة له مقابل استفادته من سرعة الإجراءات وعقوبات مخففة يتم وفق شروط وضوابط واجراءات ومراحل قانونية لضمان التطبيق السليم لهذا الإجراء.

The system of summary proceedings based on a prior admission of guilt first emerged in Anglo-Saxon countries, then spread to Latin countries, and was subsequently adopted by Arab states, including Algeria. While it is not new in comparative law, it is a recent development in Algerian law under Law No. 25-14, which contains the Code of Criminal Procedure. The system of appearance based on prior admission of guilt grants the public prosecutor the authority to shorten trial proceedings for specific crimes, either on his own initiative or at the request of the defendant or his attorney, provided the latter agrees to admit to the acts attributed to him in exchange for benefiting from expedited proceedings and reduced penalties. This is carried out in accordance with legal conditions, controls, procedures, and stages to ensure the proper application of this procedure.
