النظام القانوني للدفع الالكتروني في التشريع الاسلامي

Abstract

تتناول هذه وسائل الدفع الإلكترونية باعتبارها إحدى الركائز الأساسية في دعم التجارة الإلكترونية وتطوير المعاملات المالية الحديثة وتهدف إلى بيان المفاهيم العامة لهذه الوسائل، وأنواعها، وخصائصها القانونية، إضافة إلى المزايا التي توفرها والتحديات التي تطرحها، لا سيما من حيث الأمان القانوني والتقني كما ركزت الدراسة على الإطار القانوني المنظم لها في الجزائر، من خلال تحليل أحكام القانون 18-05 المتعلق بالتجارة الإلكترونية. وقد أظهرت النتائج وجود تقدم تشريعي نسبي، غير أنه لا يزال يفتقر إلى الإحاطة الكاملة بالجوانب التقنية والمخاطر المستجدة وخلصت الدراسة إلى ضرورة تطوير النصوص القانونية، وتحديث البنية التقنية للمؤسسات المالية، وتعزيز حماية المستخدم في بيئة الدفع الرقمي.

This dissertation addresses electronic payment methods as one of the fundamental pillars supporting e-commerce and the development of modern financial transactions. It aims to present the general concepts of these methods, their types, legal characteristics, as well as the advantages they offer and the challenges they pose—particularly regarding legal and technical security. The study also focused on the legal framework governing these methods in Algeria, through an analysis of the provisions of Law No. 18-05 related to e-commerce. The findings revealed relative legislative progress, though it still lacks comprehensive coverage of technical aspects and emerging risks. The study concluded that it is necessary to develop legal texts, modernize the technical infrastructure of financial institutions, and enhance user protection in the digital payment environment. .
