Abstract
تهدف الدراسة إلى توضيحمدى الحماية القانونية الممنوحة للمستهلك في مجال التجارة الإلكترونية، وذلك من خلال استقراء النصوص ابتداء من القواعد العامة في قانون الممارسات التجارية (04-02)، مروراً بقانون حماية المستهلك وقمع الغش (09-03)، وصولاً إلى النص المتخصص وهو قانون التجارة الإلكترونية (18-05). تم الاعتماد على المنهجين الوصفي التحليلي أساسا لإبراز الفجوة بين النصوص التشريعية والواقع التطبيقي. وقد تبين مواكبة المشرع الجزائري للمستجدات التقنية بنصوص قانونية متطورة كإقرار الحق في العدول والالتزام بالإعلام المسبق، إلا أن الفعالية الميدانية لهذه النصوص تظل محدودة نظرا لانتشار التجارة الإلكترونية الموازية، فضلاً عن قصور آليات الرقابة التقليدية في ضبط المخالفات الرقمية. The study aims to clarify the extent of legal protection granted to consumers in the field of e-commerce. This is achieved by analyzing legislative texts, starting from the general rules in the Commercial Practices Law (04-02), moving through the Consumer Protection and Suppression of Fraud Law (09-03), and reaching the specialized text, which is the E-Commerce Law (18-05). The descriptive-analytical approach was primarily adopted to highlight the gap between legislative texts and practical application. The findings reveal that while the Algerian legislator has kept pace with technological developments through advanced legal provisions—such as recognizing the right of withdrawal and the obligation of prior information—the field effectiveness of these texts remains limited. This is due to the widespread growth of informal e-commerce, as well as the inadequacy of traditional regulatory mechanisms in controlling digital violations
